The EU YouTube gambling ruling puts commercial relationships between platforms and creators under scrutiny. On 16 July 2026, the Court of Justice of the European Union ruled that reviewing a creator’s content for a commercial partnership can affect a platform’s protection from liability. The Court’s explanation sets out the distinction.

What the court decided

Case C-421/24, AGCOM, followed a €750,000 fine imposed on Google Ireland by Italy’s communications regulator in July 2022 over gambling promotions on YouTube.

The Court found that hosting gambling advertising falls within the E-Commerce Directive’s framework. But a platform’s review of channel themes, videos and metadata for a commercial partnership can give it knowledge that removes its hosting liability exemption. Three checks for gambling affiliate marketing on YouTube

A YouTube gambling affiliate needs to separate national advertising permission, platform content rules and paid advertising requirements. Approval at one level cannot settle every question.

YouTube’s regulated goods policy prohibits directing viewers to uncertified gambling sites and promising guaranteed gambling returns. Its rules cover videos, descriptions, comments, livestreams and external directions, including spoken references.

Content promoting or depicting online gambling can also be age-restricted, including content involving certified sites. The policy contains limited exceptions for certain sports-betting content. Check the exact format and circumstances before relying on an exception.

For paid placements, Google Ads has separate gambling requirements, including eligible countries, certification, responsible-gambling information and restrictions on targeting minors. Keep that review separate from approval of an organic creator upload.

Where campaigns and commissions are exposed

For a gambling YouTube channel, three income streams may sit alongside each other: platform advertising revenue, operator affiliate commissions and sponsorship fees. Each comes from a different commercial relationship.

Review the agreement behind each income stream before committing production spend. Interrupted distribution could reduce referrals and first-time depositors while leaving production costs already incurred. That is a risk scenario, not a measured consequence of this judgment.

  • CPA: Check permitted traffic sources, qualification rules and how disputed referrals are validated.

  • RevShare: Separate the effect on new-player acquisition from contractual rights over previously referred players.

  • Hybrid: Review the CPA and revenue-share components individually.

  • Creator fees: Agree what happens to payment when an integration is cancelled, removed or needs replacement.

What to review before your next promotion

Use the ruling as a reason to document campaign decisions. These are recommended operating checks, not new obligations imposed on affiliates by the Court.

  1. Map the intended audience. Record target countries and review available audience-location data. Language alone does not establish where viewers are located.

  2. Confirm offer eligibility. Request written operator confirmation of the product, market and YouTube traffic permissions. Keep legal and platform checks alongside that approval.

  3. Review the full promotion. Include the spoken script, on-screen material, description, pinned comments and destination links. Audit older videos that still send traffic.

  4. Assign responsibility for changes. Name who approves content, requests edits, pauses a campaign and deactivates links. Agree how urgent requests reach the creator.

  5. Read the payment clauses. Check traffic validation, withheld payments, termination and continuing commissions. Record the treatment of completed work and replacement content.

  6. Keep evidence and monitor referrals. Save approved versions and dated checks. After an edit or removal, reconcile affected clicks and qualifying referrals with the affiliate manager.

Consider a hypothetical poker review whose linked offer changes its market availability. Bring the changed availability to your affiliate manager and ask about the existing deal and any alternatives. Review the destination and promotion together, coordinate any necessary pause or edit, and record the change. Redirecting the link alone may leave the video’s claims unsuitable. Commission treatment still needs to be checked against the actual contract.

Monitor the Italian proceedings, official YouTube policy updates and notices from operator partners. Tighter reviews or revised creator terms are possible responses; the sources reviewed for this article do not establish a platform-wide change caused by the ruling.
